Sexual assault is any involuntary sexual act in which a person is coerced or physically forced to engage against their will, or any non-consensual sexual touching of a person. Sexual assault is a form of sexual violence, and it includes rape (such as forced vaginal, anal or oral penetration or drug facilitated sexual assault), groping, forced kissing, child sexual abuse, or the torture of the person in a sexual manner.〔(【引用サイトリンク】url=http://www.womenshealth.gov/publications/our-publications/fact-sheet/sexual-assault.html )〕〔Assault, Black's Law Dictionary, 8th Edition. ''See also Ibbs v The Queen'', High Court of Australia, 61 ALJR 525, 1987 WL 714908 (sexual assault defined as sexual penetration without consent); Sexual Offences Act 2003 Chapter 42 s 3 Sexual assault (United Kingdom), (sexual assault defined as sexual contact without consent), ''and Chase v. R.'' 1987 CarswellNB 25 (Supreme Court of Canada) (sexual assault defined as force without consent of a sexual nature)〕〔(【引用サイトリンク】publisher=Department of Justice/justice.gov.nt.ca )〕 In legal terms, sexual assault is a statutory offense in various jurisdictions, including the United States, Canada, England and Wales, Ireland, and Scotland. The legal definition of the crime of sexual assault is determined by each jurisdiction. Specific legal jurisdictions and research often use highly technical or detailed definitions of the term. In some places, such as New South Wales, the crime of sexual assault has replaced the traditional crime of rape, and is being defined as non-consensual penetrative sex.〔(‘Rape’: the penetrative sexual offence | ALRC )〕 By contrast, in other jurisdictions, the crime deals with non-penetrative sexual contact. == Definition == In the United States, the definition of sexual assault varies widely between the individual states. This is because there is no federal sexual assault laws in the United States due to the supreme court ruling of United States v. Morrison which ruled parts of the Violence Against Women Act unconstitutional. The Rape, Abuse & Incest National Network defines sexual assault as "unwanted sexual contact that stops short of rape or attempted rape. This includes sexual touching and fondling."〔 The National Center for Victims of Crime states:〔(【引用サイトリンク】title=The National Center for Victims of Crime – Library/Document Viewer )〕
